1. Acceptance of Terms
By accessing or using Bibha AI Sales Cloud (the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree to these Terms, you may not use the Service.
2. Description of Service
Bibha AI provides an AI-powered sales automation platform that may include lead generation, autonomous voice agents, email and omnichannel outreach, analytics, and related features. We may add, modify, or discontinue features at any time.
3. Accounts and Registration
To use certain features you must register for an account and provide accurate, complete information. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
4. Acceptable Use
You agree not to misuse the Service. In particular, you will not: (a) use the Service to send unsolicited or unlawful communications; (b) violate any applicable law, including telemarketing, anti-spam, and data-protection regulations; (c) attempt to gain unauthorized access to the Service or its related systems; or (d) interfere with or disrupt the integrity or performance of the Service.
5. Customer Data and Privacy
You retain all rights to the data you submit to the Service. You grant Bibha AI a limited license to process that data solely to provide and improve the Service. Our handling of personal data is described in our Privacy Policy. You are responsible for obtaining all consents required to contact your leads and customers through the Service.
6. Fees and Payment
Paid plans are billed in advance on a recurring basis and are non-refundable except where required by law. Fees exclude taxes, which you are responsible for. We may change pricing with reasonable advance notice; changes take effect at the start of your next billing cycle.
7. Intellectual Property
The Service, including all software, content, and trademarks, is owned by Bibha AI or its licensors and is protected by intellectual-property laws. These Terms do not grant you any right, title, or interest in the Service other than the limited right to use it as permitted here.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
9. Limitation of Liability
To the maximum extent permitted by law, Bibha AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly. Our total liability arising out of or related to these Terms will not exceed the amounts you paid us in the twelve months preceding the claim.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably believe your use poses a risk to the Service or other users. Upon termination, your right to use the Service ceases immediately.
11. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
